Background The following story is a fictional account of an incident that occurred during a mythical Democratic-Republican National Convention (DRNC) event in Miami, Florida. The story is loosely based on an amalgamation of real life occurrences during the Free Trade Area of the Americas conference in Miami, Florida, in 2003. The names of all the characters in the story are fictional. The planners for the DRNC have designated the American Airlines Arena (home of the basketball team Miami Heat) in downtown Miami as the main venue for the five day convention. The entire contiguous area south of the Arena (to the Bayside Shopping Center, to Bayfront Park, and onto the Intercontinental Hotel Miami grounds, just north of the river) has been designated as a secure zone. Only delegates, their families, and authorized personnel are allowed in this extended security zone during the event. This was a departure from the FTAA Conference configuration in 2003, whereby the area between the Arena and the hotel was open to the public. In 2003, the amphitheater inside Bayfront Park had been designated as a First Amendment zone where protestors were allowed and, indeed, encouraged to congregate. In fact, the amphitheater was the focal point for a joint AFL-CIO and teamster rally on the fourth day of that event. By contrast, the security footprint for the DRNC had been expanded so that the protestors could not gain access into the park and the shopping center. The added security measures were in place due to concern that violent anarchist and black bloc protestors would gain a foothold between the Arena and the Intercontinental Hotel where the delegates and the VIPs were staying. For the DRNC event, the planners moved the designated First Amendment zone to a location immediately north of the Arena, a vacant area called Bicentennial Park. Bicentennial Park and the Arena are separated by a rectangular shaped deep water enclave that measures 280 wide and 1,190 long. This deep water enclave serves as a natural barrier to separate the protestors from the main venue of the DRNC, while at the same time giving the protestors a close-up view of the Arena. A direct and close-up view of the symbolic center of the event is an important element for selecting a viable First Amendment zone that will be able to withstand any legal challenges by protest groups. This is why the planners chose Bicentennial Park this time for a place where protestors can meet and rally. The Story Bicentennial Park began filling with people as early as Monday, the week of the DRNC convention. There were several rallies planned by various protest groups such as Greenpeace, PETA, Amnesty International, and other environmental and social justice organizations. As expected, the rally was held on Thursday, the fourth day of the convention, and attracted an estimated 10,000 people to the park. Among those 10,000 attendees were a smattering of hard core anarchist and black bloc protestors. These violent professional protestors numbered around 500, but by melding into the larger crowd of peaceful protestors, they appeared to be more in number than they were. In addition, the large crowd gave them a sense of protection in that the law enforcement agencies did not want to stir up problems by aggressively targeting certain groups within the larger crowd as was done in the FTAA years earlier. In fact, the authorities made it a point to be more tolerant this time around, as long as the protestors stayed within the designated demonstration area in the park and did not stray onto the streets of downtown Miami. For that reason, the police allowed many of the protestors to camp at the park for the entire week. From Monday through Friday, Bicentennial Park became a de facto campsite for many of the protestors. The police maintained an undercover surveillance presence there but avoided sending uniformed officers into the park center.
